This case involves a 4.5-year tenant who was eviction-filed after a mandatory migration to Bilt Rewards blocked his payments — a platform RPM Living's own emails confirm was "not fully operational." RPM Living then refused payment in writing while the nonpayment case was active.

Timeline of Events

March 2024

Lease signed under Bainbridge/BlueMoon

Lease explicitly lists in-office payment and RentCafe as accepted payment methods. No mention of Bilt Rewards. RPM Living later eliminated both methods without contractual authority.

March 20, 2026

RPM Living confirms Bilt not recognizing property

Email from RPM Living confirms Bilt Rewards was not recognizing the property from day one of the mandatory migration. This is the beginning of the documented failure.

April 1, 2026

RPM Living confirms platform "not fully operational"

Written confirmation from RPM Living that Bilt Rewards was "not fully operational." Tenant had been making contemporaneous objections prior to this date, distinguishing the situation from buyer's remorse.

April 8, 2026

Automated eviction notice generated / lease renewal sent simultaneously

On the same day, RPM Living sent a lease renewal confirmation and generated an unsigned eviction notice. No human was reviewing the file. The process was entirely automated.

April 13, 2026

Cure deadline in notice (never received)

The 5-Day Notice to Vacate's own cure deadline. The tenant had not yet received the notice at this point.

April 15, 2026

Defective notice delivered — after its own deadline

William Carrion emailed the notice screenshot ("for your reference, a copy of that notice is attached") — two days after the cure deadline had already passed. The notice is unsigned, contains the wrong lease date, states an incorrect rent amount, and was delivered after its own cure period expired. Five independent defects.

April 22, 2026

Payment blocked — timestamped screenshot

Timestamped screenshot documents payments blocked in the Bilt platform. Two days before the eviction filing.

April 24, 2026

Summary ejectment filed

RPM Living files Case No. 26CV015708-910 in Wake County. Filing came exactly 9 days after the tenant's documented complaints reached RPM Living's CEO. Audio recording confirms tenant's account had already been flagged "evicted" in RPM Living's system before this legal filing — meaning the payment block preceded any legal authority to act.

April 28, 2026

RPM Living refuses payment in writing

While an active nonpayment eviction case is pending, RPM Living refuses payment in writing. A plaintiff in a nonpayment suit refusing the payment they sued to collect. This document is preserved.
